If you have sustained a personal injury, which was someone else’s fault, you may be able to claim compensation for, general damages and special damages. General damages are paid as compensation for injury, pain and suffering and, special damages is an award for additional losses, such as loss of earnings and future earnings. Most personal injury claims are resolved outside of the Courts however, for complex and high value claims it may be necessary for a Court to agree the compensation, similarly all children matters (under 18) will need Court approval.

Personal Injury refers to physical or psychological injury or illness that is caused by the negligence of another. A successful personal injury claim will result in financial compensation for the injured party. Personal injury claims are subject to time limitations. In the UK you are able to make a claim within 3 years of the accident. It is advisable that you make the claim as soon as possible to give your solicitor more time to build the best possible case for you.

In most successful No Win, No Fee claims, claimants are responsible for part of the cost payable to their Solicitor, known as a ‘success fee’. The amount is limited to 25% of any compensation received, excluding awards for any future losses. In some claims, you may agree to utilise an After the Event Insurance Policy, if so, you are liable for an element of the premium.

If your claim is unsuccessful, then you do not have to pay any costs to your Solicitor, unless otherwise, mutually agreed.

The majority of personal injury claims settle before Court action is necessary, unless liability is denied, the case is complex or there are arguments over the correct level of compensation. In many cases, if the value of your claim is under £25,000 it is possible to agree settlement without the need to attend Court.
Solicitors, in claims worth £25,000 or less are paid a fixed fee by the Defendant Insurer, plus up to 25% from your compensation, as your contribution towards your legal fees. We do not ask for this from the outset and your contribution is deducted from your compensation once received.
If the claim is for a minor (someone under the age of 18), we do not take any contribution towards our legal fees from their compensation.
