In one particular case, the Claimant presented at hospital with symptoms which were investigated and thought by a specialist to be cancer. However there was insufficient follow-up as a result of which there was a delay of about 18 months in confirming the diagnosis. This resulted in more aggressive treatment being needed and a more uncertain prognosis.
Pregnancy, birth and gynaecology claims
These types of case are one of the more common areas of clinical negligence that we encounter. For example, a client for whom I act had a very traumatic birth due to a failure by the hospital to react promptly and appropriately to signs of fetal distress during labour. Consequently, the client suffered oxygen deprivation and potentially serious neurological injuries.
Eye related claims
With the advent of laser eye surgery we are seeing an increase in these claims, although they are not confined to laser treatment. Indeed, one client is suing an NHS hospital for the negligent performance of cataract surgery which has meant they have had to undergo the procedure again to correct it.
